Last week’s vote on Parliament’s resolution on cardiovascular health prevention, while non-binding, offers important political signals ahead of the European Commission’s expected revision of the EU tobacco and nicotine framework in late 2026.

For the nicotine pouch sector, the message is not simply one of tighter regulation. Alongside calls for stronger youth-access measures and stricter oversight of marketing practices, lawmakers have also acknowledged a principle often missing from the debate: different nicotine products may present different risk profiles. That recognition could prove significant as Brussels begins considering how nicotine pouches fit into a revised regulatory framework.

Parliament Recognises Different Risk Profiles

One of the most noteworthy elements of the resolution is Parliament’s recognition that nicotine products differ in both nicotine delivery and nicotine content and may therefore present different risk profiles.

That may sound obvious, but in Brussels it matters.

Nicotine pouches have often been discussed alongside cigarettes despite the clear differences between combustible tobacco and smoke-free nicotine products. By acknowledging differentiated risk profiles, Parliament appears to be moving towards a more nuanced assessment of the nicotine market rather than treating all products as a single category.

The most significant part of the resolution may be Parliament’s call to include all non-medicinal nicotine products within the scope of both the Tobacco Products Directive and the Tobacco Advertising Directive, presenting a significant opportunity smokers who want access to a significantly less harmful category, whilst at the same time ensuring a high level of public health protection.

Today, Member States have adopted different approaches to nicotine limits, flavours, marketing, product standards and market access, creating uncertainty for manufacturers, retailers and consumers alike.

A harmonised EU framework could provide long-awaited legal clarity and a more predictable regulatory environment across the single market.

The resolution also calls for the introduction of pre-market health impact assessments for new nicotine products, including nicotine pouches. While ensuring product safety is a legitimate objective, policymakers should be cautious about creating approval systems that become unnecessarily burdensome. Excessive pre-market requirements could slow innovation, delay access to new products and create barriers. Considering that this measure is only called for with regards to reduced risk categories and not to the much more harmful combustible products, it would likely be disservice to public health.

Youth Access Remains the Primary Concern

If Parliament’s recognition of risk differentiation is encouraging, youth access rightly remains the dominant concern.

Lawmakers expressed concern about the uptake of nicotine pouches and other novel nicotine products among minors, pointing in particular to flavours, packaging and product appeal.

The resolution calls for:

  • Stronger enforcement of age restrictions;
  • Enhanced age-verification requirements at physical retail outlets;
  • More consistent rules for online sales, including stronger age-verification measures through the swift implementation of the EU Digital Identity Wallet;
  • Greater investment in prevention and education measures aimed at young people.

These are objectives that should command broad support. The key policy question moving forward is not whether age restrictions should exist, but how they can be enforced effectively across both physical and digital sales channels.

Social Media Advertising Moves Into the Spotlight

Advertising and promotion are emerging as another major battleground.

Parliament has called for stronger controls on the advertising, promotion and sponsorship of nicotine products across all communication channels, with particular attention given to social media.

MEPs specifically called for social media advertising to be explicitly covered by the Tobacco Advertising and Sponsorship Directive and urged action against indirect marketing practices that may increase product appeal among minors.

Concerns about digital marketing are growing, and nicotine products are increasingly being drawn into wider debates about online consumer protection, influencer marketing and youth exposure to age-restricted products.

The Bigger Picture

The European Parliament has made one thing clear: nicotine pouches are set to become part of the EU’s future tobacco and nicotine framework.

While lawmakers are pushing for stronger youth-access controls and tighter advertising rules, they have also recognised that different nicotine products may present different risk profiles. That acknowledgement creates an important foundation for a more evidence-based regulatory debate.

As the Commission prepares its proposals, the challenge will be to develop rules that protect young people, provide legal certainty and reflect the distinct characteristics of nicotine pouches rather than simply treating them as another tobacco product. For a category that has often existed outside the EU legislative framework, that debate may prove just as important as the final rules themselves.
